[사회정의를 바라는 전국교수모임](정교모)은 2020년 5월 28일 중국 전인대에서의 <홍콩 보안입법에 관한 결정>은 反인권·反민주·反문명의 행위임을 규탄하면서 법제화를 반대하는 성명서를 발표하였다. 또한 6월 5일(금) 오전 10시 30분, 서울 프레스센터 외신기자클럽에서 이와 관련 기자회견을 가지고 성명서를 발표한다.



국문, 영문, 중문, 일문으로 번역된 정교모의 성명은 이 결정이 법제화됨으로써, 홍콩은 △ ‘일국양제’(一國兩制)에 따라 보장되는 체제적 자율성이 본질적으로 훼손되고, △ 단순시위도 처벌 가능하여 사실상 대규모 시위를 합법적으로 탄압할 수 있게 되며, △ 민주 인사의 선거권 박탈로 汎민주 진영을 박해할 것이고, △ 반중 인사는 마카오, 신장, 티벳 등에서 보듯이 장기 징역형 등 무거운 형벌과 극단적 인권 탄압을 받게 될 것이며, △ 중국 정보기관 상주로 반중 인사에 대한 감시와 검거가 자행될 것이고 △ 보안법의 입법과정에서 홍콩 사람들이 배제됨으로써 홍콩인의 자치권이 부정되고 ‘일국양제’ 원칙이 형해화(形骸化)되는 처참한 결과가 예상된다고 판단했다.

 

정교모는 먼저, ≪홍콩 보안법≫으로 불리는 중국 전인대의 결정은 ≪홍콩 기본법≫ 제3장 ‘주민의 기본 권리와 의무’ 조항에 보장된 기본권을 심대하게 유린하는 反인권 폭거로 규탄했다.

 

둘째, 정교모는 중국 전인대의 결정은 이미 홍콩인에게 부여되어 있는 민주적 자치권을 심대하게 제약할 수밖에 없음을 적시하고, 이 결정의 反민주성을 고발했다. 정교모는 이번 결정이 6월 전인대 상무위원회에서 법제화됨으로써 홍콩의 민주주의와 고도의 자치가 중국 공산당의 공안 통치에 의해 억압될 것임을 우려하고 규탄했다.


셋째, 정교모는 이 결정은 영국과 중국 간에 체결된 ≪홍콩 반환 조약≫에 의해 만들어진 ≪홍콩 기본법≫ 규범, 그리고 국제사회와 홍콩인에 대해 중국 스스로가 한 ‘일국양제’의 약속이 파기된 反문명적 폭거임을 규탄했다. 이 결정은 “약속(계약)은 지켜져야 한다.”(Pacta Sunt Servanda)는 오래된 법과 문명의 원칙에 反하는 야만적 도발로 규정했다.

 

정교모는 ≪홍콩 보안법≫이 자유 홍콩인에게서 인권의 강탈하고, 민주주의를 회수하며, 문명을 파괴함으로써 시진핑의 중국에게 공산당 전체주의 독재를 유지하고 강화하는 ≪중국 공산당 보호법≫에 다름 아님을 지적했다.

 

이에 정교모는 14억 중국인은 ‘중화문명’의 영예, 중국 인민이 각고의 노력으로 이룬 G2의 자부심을 걸고, 홍콩이 인권·민주·문명을 지속할 수 있도록 중국 공산당의 ≪홍콩 보안법≫ 법제화에 결연히 반대해 줄 것을 호소했다.

 

아울러 정교모는 이번의 국제 성명서를 발표하면서, 홍콩인의 인권, 홍콩의 민주적 자치와 문명의 관문이 유지될 수 있는 국제적 지식인 연대활동에 앞장설 것을 결의하고 국제적인 연대활동에 돌입하기로 했다고 밝혔다.

 

대한민국, < 사회정의를 바라는 전국교수모임(정교모) > 국제성명서는 다음과 같다. 

 

중국 전인대의 ≪홍콩 국가보안입법에 관한 결정≫ 은 

反인권·反민주·反문명의 행위임을 규탄하고 그 법제화를 반대한다.

 

2020년 5월 29일 <중화인민공화국(이하 중국) 전국인민대표대회(이하 전인대)>는 약칭 ≪홍콩 국가보안입법에 관한 결정≫을 통과시켰다. ≪홍콩 보안법≫으로 불리는 이 법안의 실제 명칭은 ≪홍콩 특별행정구의 국가안전을 수호하는 법률제도와 집행기제 수립 및 완비에 관한 전국인민대표대회의 결정(全国人民代表大会关于建立健全香港特别行政区维护国家安全的法律制度和执行机制的决定)≫이다. 이 결정은 다음달 6월에 <중국 전인대 상무위원회>에서 법률로 제정될 예정이다.

 

이 결정은 △ 국가안전을 해치는 행위와 활동을 예방·금지·처벌하고, △ 분리독립, 전복, 테러리즘, 외부 세력과의 공모 행위를 금지하며, △ 중국 정보기관의 홍콩 내 기구를 설치하고, △ 국가안보 교육을 시행한다는 내용을 담았다. 이 결정에 따라 <중화인민공화국 공안부>가 홍콩 경찰의 지휘권을 인수하고, 중국 공안이 그 권력을 전면적으로 행사할 것임을 적시하였다.

 

이 결정이 법제화됨으로써, 홍콩은 △ ‘일국양제’(一國兩制)에 따라 보장되는 체제적 자율성이 본질적으로 훼손되고, △ 단순시위도 처벌 가능하여 사실상 대규모 시위를 합법적으로 탄압할 수 있게 되며 △ 민주 인사의 선거권 박탈로 汎민주 진영을 박해할 것이고, △ 반중 인사는 마카오, 신장, 티벳 등에서 보듯이 장기 징역형 등 무거운 형벌과 극단적 인권 탄압을 받게 될 것이며, △ 중국 정보기관 상주로 반중 인사에 대한 감시와 검거가 자행될 것이고 △ 보안법의 입법과정에서 홍콩 사람들이 배제됨으로써 홍콩인의 자치권이 부정되고 ‘일국양제’ 원칙이 형해화(形骸化)되는 처참한 결과가 예상된다.

 

이에 대한민국 < 사회정의를 바라는 전국교수모임 (정교모, The Professors’ Solidarity for Freedom and Justice, PFJ = 社會正義全國敎授聯盟, 正義敎盟 = 社会正義全国教授連盟、正義教盟 = 社会正义全国教授联盟,正义教盟) >는 중국 전인대의 ≪홍콩 보안법≫ 결정이 反인권·反민주·反문명의 폭거임을 고발하고, 인권·민주·문명을 존중하는 모든 국가와 지식인·시민사회단체와 더불어 이 결정의 법제화에 반대할 것을 결의한다.

 

중국 전인대의 ≪홍콩 보안법≫ 결정은 이미 홍콩인에게 부여되어 있는 ‘인권(기본권)’을 심대하게 유린할 독소 조항을 담고 있는 反인권 결정임을 선언한다. 이 결정이 법제화될 경우 ≪홍콩 보안법≫은 ≪홍콩 기본법≫ 제3장 ‘주민의 기본 권리와 의무’를 본질적으로 침해할 수 있음을 확신한다.

 

특히 동법 제28조 “홍콩 주민의 인신의 자유는 침범 받지 아니 한다”와 “홍콩 주민은 어떠한 의도에서도 불법적인 체포·구금·감금을 당하지 아니한다. 어떠한 의도에서도 불법적으로 주민의 신체를 수색하거나 주민의 인신의 자유를 박탈, 제한하는 것을 금지한다.

 

주민에게 가혹한 형벌을 가하거나 불법으로 주민의 생명을 박탈하는 것을 금지한다.”는 조항과 정면으로 배치된다. 따라서 우리는 이 反인권 결의가 결단코 법제화되어서는 아니 됨을 선언한다.

 

중국의 ≪홍콩 보안법≫ 결의는 이미 홍콩인에게 부여되어 있는 민주적 자치권을 심대하게 제약할 수 있음을 확신한다. 이에 우리 이번 결의의 反민주성을 규탄하고 고발한다.

 

≪홍콩 기본법≫은 제25조에서 “홍콩 주민은 법률 앞에서 모두 평등하다.” 제26조에서 “홍콩특별행정구의 영구(永久) 주민은 법에 따라 선거권과 피선거권을 향유한다.” 제27조 “홍콩 주민은 언론·신문·출판의 자유를 향유하며 결사·집회·여행·시위의 자유가 있고 노동조합과 파업을 조직하고 참가할 권리와 자유가 있다.”고 규정하고 있다.

 

아울러 ≪홍콩 기본법≫은 ‘일국양제’의 원칙에 따라 ‘공산당 독재’가 아니라 입법·행정·사법으로 분립된 권력구조에서 고도(高度)의 민주주의적 자치를 보장하고 있다. 이번 결의의 법제화는 홍콩의 민주주의와 고도의 자치가 중국 공산당의 공안통치에 의해 억압되고 종식되는 것의 출발점이 될 것이다.

 

중국의 ≪홍콩 보안법≫ 결의는 영국과 중국 간에 체결된 ≪홍콩 반환조약≫에 의해 만들어진 ≪홍콩 기본법≫ 규범, 그리고 국제사회와 홍콩인에 대해 중국 스스로가 공언한 ‘일국양제’의 약속이 파기되는 反문명적 폭거임을 규탄한다. 인류는 인간과 인간, 국가와 국가 간에 자발적으로 이루어진 약속(합의)을 통해 문명의 역사를 만들어 왔다. “약속(합의)은 지켜져야 한다.

 

”(Pacta Sunt Servanda)는 보편규범은 인간과 인간, 그리고 국가와 국가 사이의 관계를 규율하는 ≪시민법≫·≪만민법≫과 ≪민법≫·≪국제법≫의 뿌리 깊은 법의 정신이자 원리이며 문명의 금언(金言)이다. 중국은 홍콩인과 영국 및 국제사회에 대하여 한 약속을 스스로 어긴 것이다. 이 결의는 反인권, 反민주의 폭거일 뿐만 아니라 인류의 문명에 反하는 야만적 도발인 것이다.

 

홍콩은 당초에 약속된 바와 같이 2047년까지 ‘일국양제’의 법적 · 정치적 · 문명적 원칙에 의하여 인권과 자주가 보장되고, 그로써 중국의 체제진화와 세계화를 견인하며, 보편적 인권과 민주주의·시장경제의 선진문명을 중국에 유입시키는 개방과 진화의 관문(關門) 역할을 지속할 수 있어야 할 것이다.

 

이상에서 밝혔듯이 우리 < 사회정의를 바라는 전국교수모임 (정교모) >의 모든 회원은 금번 중국 전인대의 ≪홍콩 보안입법≫ 결정이 전인대 상무위원회에서 법제화되어서는 아니 됨을 천명한다. ≪홍콩 보안입법≫이 실현되면, 그것은 홍콩인에게 부여된 인권을 말살하고 민주주의를 파괴함으로써 결국 시진핑의 중국이 공산당 전체주의 독재를 유지하고 더욱 강화하도록 하는 ≪중국공산당 보호법≫으로 화할 것이다.

 

14억 중국인민은 ‘중화문명’의 영예와 각고의 노력으로 이룬 G2의 자부심을 걸고, 홍콩이 인권·민주·문명의 향유를 지속할 수 있도록, 중국 공산당의 ≪홍콩 보안입법≫ 추진에 결연히 반대해 줄 것을 호소한다. 중국의 ≪홍콩 보안법≫ 제정은 단순한 중국 국내법의 문제가 아니다.

 

중국과 홍콩의 장래를 넘어, 인류사의 재앙을 만들 수 있다는 사실을 환기한다. 지금은 1948년 제정된 ≪세계인권선언≫ 전문(前文)의 첫 단락과 마지막 문장을 우리 모두의 마음에 새기고 행동하여, 오늘의 사태가 야기할 수 있는 인류사의 재앙을 막아야 할 절체절명의 시점이다.

 

“존엄성과 양도할 수 없는 권리를 인정하는 것이 세계의 자유 · 정의 · 평화의 기초다. 인권을 무시하고 경멸하는 만행이 과연 어떤 결과를 초래했던가를 기억해 보라. 인류의 양심을 분노케 했던 야만적인 일들이 일어나지 않았던가? (…) 이 선언에서 말한 어떤 권리와 자유도 다른 사람의 권리와 자유를 짓밟기 위해 활용될 수 없다. 어느 누구에게도 남의 권리를 파괴할 목적으로 자기 권리를 행사할 권리는 없다.”

We Oppose to the Enactment of the National Security Law of Hong Kong, upon Denouncing the Decision of the National People’s Congress of China on the Law as a Measure Transgressing the Human Rights, Democracy and Civilization!

 

International Statement issued by The Professors’ Solidarity for Freedom and Justice,

The Republic of Korea, June 5th, 2020

 

On May 29th 2020, the National People’s Congress (“NPC”) of People’s Republic of China approved the bill on the Hong Kong’s National Security Law. The official title of this bill is the National People's Congress Decision to Establish and Improve a Legal Framework and Enforcement Mechanism for Safeguarding National Security in the Hong Kong Special Administrative Region. The decision is supposed to be enacted as a law in June by the Standing Committee of the NPC.

 

The decision includes such measures that (i) prevent, prohibit and punish any actions against the national security, (ii) prohibit separatism, subversion of state power, terrorism and collaboration with foreign powers, (iii) establish a Chinese intelligence in Hong Kong, and (iv) implement educational programs on the national security. According to this decision, the Ministry of Public Security of China is instructed to take over the authority of police in Hong Kong, and to exercise the full authority over the police.

 

With the legislation of this decision, in Hong Kong (i) the systemic autonomy guaranteed under the principle of “one country-two systems” will be essentially damaged, (ii) any rally in a large scale will be prohibited as a matter of fact because any type of demonstration may be subject to the legal punishment, (iii) any civil democratic camps may be oppressed as democratic leaders will be deprived of their rights to vote, (iv) anti-China people, as happened in Macao, Xinjiang and Tibet, will be subject to the severe punishment such as a long-time imprisonment and an extreme degree of deprivation of human rights, (v) the surveillance and arrests of anti-China people will be intensified after the establishment of Chinese intelligence agency in Hong Kong, and (vi) the exclusion of Hong Kong people in the process of enacting the National Security Law will result in the suppression of autonomy of Hong Kong people.

 

Considering these, The Professors’ Solidarity for Freedom and Justice denounces the decision of the National People’s Congress of China on the National Security Law of Hong Kong as a violent measure transgressing the human rights, democracy and civilization, and resolves to oppose to the legislation together with all nations, intellectuals and civil society groups that respect the human rights, democracy and civilization. Our declarations are as follows:

 

1. We declare that the decision stands against human rights that include poisonous clauses infringing upon fundamental human rights of Hong Kong people. Legislation of this decision will certainly impede basic rights and obligations of Hong Kong residents as stipulated in Chapter III of the Basic Law of the Hong Kong. Specifically, this decision runs against Article 28 Section 1 “The freedom of the person of Hong Kong residents shall be inviolable.” and Section 2 “No Hong Kong resident shall be subjected to arbitrary or unlawful arrest, detention or imprisonment. Arbitrary or unlawful search of the body of any resident or deprivation or restriction of the freedom of the person shall be prohibited. Torture of any resident or arbitrary or unlawful deprivation of the life of any resident shall be prohibited.”

 

2. It is certain that the decision will seriously damage democratic autonomy that is already bestowed to Hong Kong people. We denounce and report the anti-democratic nature of the decision. According to the Basic Law, it is stated that “all Hong Kong residents shall be equal before the law” in Article 25, “permanent residents of the Hong Kong Special Administrative Region shall have the right to vote and the right to stand for election in accordance with law” in Article 26, and “Hong Kong residents shall have freedom of speech, of the press and of publication; freedom of association, of assembly, of procession and of demonstration; and the right and freedom to form and join trade unions, and to strike” in Article 27. Moreover, the Basic Law guarantees a high degree of democratic self-governance under the principle of one country-two systems and separation of power among legislative, executive and judicial branches, upon denial of dictatorship by a communist party. The legislation of the decision will put a starting ground to oppress and destroy the democracy and autonomy through the public security governance by the Chinese Communist Party (“CCP”).

 

3. We denounce the decision as a violent measure against the civilization that renounces the norm of Basic Law, the result of the Sino-British Joint Declaration, and the principle of one country-two systems, which China advocated by its own initiative towards international community as well as Hong Kong people. The history of mankind and civilization has been created by agreements and commitments made between human beings and nations. The principle that “agreements of the parties must be observed” (Pacta Sunt Servanda) is the core maxim of civilization and the long-standing spirit of the civil law and the international law regulating the relationships between human beings and nations. By the decision, China violated this agreement and commitment against Hong Kong people, United Kingdom and international society. The decision violently transgresses human rights, democracy and human civilization. Hong Kong should be assured, as originally promised, of its human rights and independence through the legal, political, and civilization principles under the one country-two systems until 2047, leading China's systemic evolution and globalization, and promoting universal human rights, democracy, and market economy. It should be able to continue to serve as a gateway to openness and evolution that brings advanced civilization into China.

 

Each member of The Professors’ Solidarity for Freedom and Justice demands that the decision on the Security Law of the NPC must not be enacted into the law by the Standing Committee. Such an enactment will only maintain and reinforce the communist totalitarianism and dictatorship of Xi Jinping in China as a law protecting interest of the CCP, at the sacrifice of Hong Kong people’s human rights and democracy. We hope that 1.4 billion of Chinese people, with honor ingrained in the Chinese civilization and pride as G2 nation achieved with great deal of effort, will be able to defeat the legislation in order to help retain human rights, democracy and civilization of Hong Kong. The law is not a matter of local legislation. We remind China of the possibility of its catastrophic impacts on the future of China and Hong Kong as well as on the stream of human history. Now is the time to make a cut-off to prevent the calamities that can be caused by today's wrong events by engraving and acting on the hearts of all of us in the first paragraph and the last sentence of the Universal Declaration of Human Rights, enacted in 1948:

 

“Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world, Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, (…) Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein.”
